What has to be listed on the West Virginia estate appraisement?
Everything the decedent owned or held an interest in: all probate and nonprobate real estate, including jointly held property and life estates, and all probate personal property, tangible and intangible, from furniture and vehicles to stocks, bank accounts, and notes, each at its fair market value on the date of death. W. Va. Code 44-1-14 puts the form in the Tax Commissioner's hands and the 90-day deadline on the personal representative.
Is West Virginia a community property state?
No. It is an equal-division state: W. Va. Code 48-7-101 directs the court to divide marital property equally, and the exceptions that allow an unequal split are set out in the same article. Because the starting point is 50/50 by value, the appraised worth of the business, the equipment, and the collections decides what each spouse actually walks away with.
